Letter to the Hon Julian Hill MP | Suggested amendments to MD 106

In a letter dated October 14 2026, the Hon Dr Peter Hendy, on behalf of IHEA, proposed amendments to
Ministerial Direction No. 106 (MD 106) to provide greater transparency, consistency and certainty in its
application.

Dr Hendy highlighted the considerable uncertainty for prospective students and education providers about how
some of the factors identified in MD 106 are applied in practice, including the circumstances that trigger
further scrutiny or requests for additional evidence and the weight given to particular factors in reaching a
decision.
